HB2797 challenges Roe v. Wade and threatens contraception!

HB 2797 Personhood from the moment of fertilization, introduced by anti-choice hardliner Del. Bob Marshall (R-13), simply states "That life begins at the moment of fertilization and the right to enjoyment of life guaranteed by Article 1, § 1 of the Constitution of Virginia is vested in each born and preborn human being from the moment of fertilization."

This bill is an outrageous attempt to undermine Roe v. Wade and threaten access to FDA-approved methods of contraception, like IUDs, Emergency Contraception or even basic birth control.

Background Information

If passed, HB 2797 would undermine Roe v. Wade and threaten access to many kinds of FDA-approved methods of contraception. By recognizing a fertilized egg or a fetus as a person that has separate legal rights equal to that of a woman, this legislation is clearly trying to establish fetal personhood. This creates a tension with the Supreme Court’s decision Roe v. Wade, where the Court ruled that the word ‘person’ as used in the 14th Amendment does not include the unborn.
